Letter to Alachua County Legislative Delegation Opposing Proposed Legislation Preempting Alachua County's Airboat Curfew Ordinance (Amended)

The Board of County Commissioners, at its meeting of January 12, 2012, requested a letter be prepared opposing Senate Bill 958 and House Bill 773, which established sound level testing and certification for airboats. This legislation preempts the voter-approved airboat curfew airboat ordinance adopted in 2010 by a vote of 56% for the airboat curfew.
At its meeting of January 12, 2012, the Board directed that a draft letter be prepared opposing Senate Bills 58 and House Bill 773. The Board discussed the draft letter at its meetings on January 17, 2012. The proposed legislation would require the Florida Fish and Wildlife Commission to certify airboats that emit 107 dBs of noise while traveling on a plane from a distance of 100 feet. Once certified, the Commission would issue a decal to the owner of the airboat.. The legislation further preempts any local government ordinance that discriminates against airboats that bear the decal certifying that the noise level criteria have been met.
