Agenda Item #21 Title Second and Final Public Hearing for a Text Amendment to the Unified Land Development Code for Indoor Sports Training Facilities (Amended) Amount N/A Description A request for a text amendment to modify the zoning districts where 'Indoor Sports Training Facility' is allowed as a Limited Use, to establish standards for the use, and additional modifications to Personal Services in the Use Table. Recommendation 1. Convene as the Land Development Regulation Commission and find the proposed ordinance consistent with the Alachua County Comprehensive Plan: 2001-2020. 2. In addition, Staff has proposed changes to move 'Indoor Sports Training Facility', 'Gym, spa, or fitness center', and 'Dance, art, or similar studio' to the 'Personal Services' section of the use table. This is the second of two required public hearings for adoption of this ordinance. Background On April 19, 2010 the Growth Management Department received an application from Phoenix Industrial Park requesting to make 'Indoor Sports Training Facility' a Limited Use within the ML, MS, and MP zoning districts in Rural Employment Center Future Land Use designations. Policy 6.3.3 of the Future Land Use Element indicates that commercial uses consistent with Policy 3.11.1 may be allowed in the Rural Employment Center Future Land Use designation. Policy 3.11.1 specifically references personal services. Therefore, 'Indoor Sports Training Facility' (ISTF) may be allowed in the ML, MS, and MP districts that implement the Rural Employment Center Future Land Use designation.However, while developing the specific limited use standards for an ISTF, staff identified that several uses in the Use Table that should be listed under Personal Services are listed in other places. Therefore, Staff has moved three items to the Personal Services portion of the Use Table: 'Indoor Sports Training Facility', 'Gym, spa, or fitness center', and 'Dance, art, or similar studio'. In addition, no definitions were provided for ISTF, gym, spa, or fitness center. In order to clarify the difference between an ISTF and fitness center, definitions were created for these (gym was also defined as a fitness center). Spa was added to the definition of personal service. Finally, language was added to clarify that an ISTF is not the same as a vocational educational facility. Issues Use of Indoor Sports Training Facilities for tournaments or competitions is not precluded by the definitions established. An indoor tournament or competion would be considered a customary accessory use and would be allowed.
